RTI: Govt couldn’t frame National Litigation Policy in 07 years

The RTI information provided by the Department of Legal Affairs to activist Dr Nutan Thakur reveals that the Central Government has not been able to frame a National Litigation Policy despite work going on for the last 07 years.


Nutan had sought certain information about National Litigation Policy and its current status.

The CPIO of Department of Legal Affairs responded by saying that the work on National Litigation Policy started in the year 2010. He said that though a National Litigation Policy was formulated in the year 2010, it could not be approved by the Government and the reformulation of the National Litigation Policy is still under the active consideration of the Government.

The Government declined to provide other documents related with the process, citing section 8(1)(i) of the RTI Act which excludes Cabinet papers from RTI.

As per Nutan, it is truly strange that the Central Government could not complete such an important work during the last 07 years, while Government litigations are increasing at an alarming rate.

आरटीआई: 07 वर्षों में नहीं बन पायी राष्ट्रीय मुक़दमा नीति

विधायी विभाग, भारत सरकार द्वारा एक्टिविस्ट डॉ नूतन ठाकुर को आरटीआई में दी गयी सूचना से यह बात सामने आई है कि भारत सरकार पिछले 07 वर्षों से काम करने के बाद भी एक राष्ट्रीय मुक़दमा नीति नहीं बना पायी.

नूतन ने राष्ट्रीय मुक़दमा नीति तथा उसकी वर्तमान स्थिति के सम्बन्ध में कुछ सूचनाएँ मांगी थी. विधायी विभाग के जन सूचना अधिकारी ने बताया कि राष्ट्रीय मुक़दमा नीति पर वर्ष 2010 में काम शुरू हुआ था.  उस समय एक राष्ट्रीय मुक़दमा नीति तैयार हुआ था किन्तु सरकार द्वारा उसका अनुमोदन नहीं हो सका, जिसके बाद से राष्ट्रीय मुक़दमा नीति को दुबारा तैयार किये जाने का कार्य सरकार के स्तर पर तेजी से किया जा रहा है.

सरकार ने इस प्रक्रिया से जुड़े अन्य अभिलेख आरटीआई  एक्ट की धारा 8(1)(i) में देने से मना कर दिया जो कैबिनेट के दस्तावेजों से सम्बंधित है.

नूतन के अनुसार यह वास्तव में कष्टप्रद है कि भारत सरकार पिछले 07 वर्षों में इतना महत्वपूर्ण अभिलेख तैयार नहीं कर सकी है जबकि सरकारी मुकदमों की संख्या तेजी से बढती जा रही है.
