Safeguards against torture of Women

Good Day Brothers and Sisters,
Its thursday, 16 January 2008

Good Morning and a Great New Day full of laughter,
joy and peace to you all
Starting off rightaway with an article for the protection and
rights of women against abuse ......

legal safeguards against torture of women

The law speaks about certain Acts in India to safeguard the women
from being harrassed .
these are
- the Dowry Prohibition Act,

- Prevention of cruelty of married woemn Act,

- the Cr.P.C for claiming for the maintenance ,

- the Hindu marriege Act and above all

- the constitutional rights of a safe and secure life.

the new IT Act prohibits stalking and harassment to women.

Apart from these laws, every state has a woman's right's cell,
self help groups who not only counsel battered women
but also help them to be financially independent,
the destitutte women's home and a whole lot of NGOs
who are constantly working for the betterment of the women.
the establishment of family courts is yet another step
where free legal aid is available for poor women .
But .... there still remains some lacuna which needs to be filled up.

defences for the women
The more the modern women have progressed worlwide,
issues such as rights of the women, domestic violence, and offences like rape ,
harrassment and brutal killing of women for various reasons
like fulfilling unnatural lust, ego clash, suspicion have come up more in light .

In India especially where a goddess is worshipped as the source of peace,
prosperity, wealth, health and even for getting male heir,
hopelessly, the women in reality are the major victims of violence,
both doemstic as well as social.

Still now many households in villages in interior India feel a girl child as a burden,
female student population in rural India is a matter of shame and even when
kalpana chawla is being remembered as the first Indian astronaut,
or schools and colleges encourage students to become like another astronaut
of Indian origin like Sunita williams, many teenage girls could not even see
an atlas as they were forced to be prepared for marriage at a tender age of 15 or 16.
In urban india it is not a new phenomenon for every second home
of working couple to have fearesome fights over the trivial matters .
even though the picture of urban modern india regarding education of women
is very different from the rural sector, every woman has to face abuse at home
or at office "because she is a woman".

Now let us discuss about the types of offences which victimise a woman ;
1. physical abuse ,
2 . verbal abuse,
3. emotional torture,
4. cyber stalking.
As for physical abuse , allmost daily 90% of the rural women and nearely 70%
of the urban educated women face some kind of physical abuse .

it may vary from severe beatings by the spouse, slaps, causing burns,
to even touching a woman teasingly by her male colleagues.

well we are all aware of the case of physical harrassment of one lady I.A.S officer
and the ex supercop of punjab.
but very few cases come up to the actual limelight of this sort.
Verbal abuse is not a new phenomenon in Indian families.
there is no family in India whether rich or poor where the wives are not verbally
demeaned. many women treat it as a part of the family life
but unfortunately many fall victims of suicide, mental depression
because of constant verbal abuse by the family members.
Perhaps the most untouched part in the segment of domestic violence is
emotional torture on a woman.
many of the working women have to hear about how she neglects the house
and children to be a super proffessional and there by get constant comparisons
with other supermoms. well, the same woman gets to hear in the work place
how inefficient she is as she keeps on thinking about her family.
the emotional drainage of the mental balace causes serious harm to the woman
which goes unnoticed everywhere.
Last but not the least is the targeting of women in the internet.
women are the victims of cybersex, stalking and harrassment.
receiving obscene mails daily from someone ot the other may
not be a very new thing for a regular user of the internet.
similarly she may be threatened , blackmailed by unidentified persons
who uses modern technics to defame her in public.
unfortunately, in India where a woman deity is worshipped as the source
of power, wealth , health and even for getting child,
abuse of woman is just another way of life.

legalised offences commited by married women
It sounds funny.. but yes it is true married women do commit many "offences "
which are punishable by law. well, the husbands would be happy to know that:
1. being perfectly allright but refusing to having sex is an offence for married spouses.
2. not cooking or serving food to the family when the women do have sufficient time
for doing this, is again an offence.
3. refusing to have children when she is perfectly allright is again another offence.
4. after marriage, refusing to stay with the husband without any valid reason is an offence.
5. false allegation agains the husband or any member of the inlaws family
is also an offence.
Some of these points were upheld by the Supreme court of India
in a recent case between an IAS couple.
Well, these points are eye opener as how some misuse the legal safety
provided to the women folk.
It is not allways that women are always victimised.
even women are also at par with men in creating domestic violence.

common violence against married women all over the world
whether developed world or underdeveloped world ,
women especially married women in every country suffers from domestic violence............ ......... ......more to come

Spare a thought for our women ..
They suffer the same as we do and in many cases much more ...
Even when they abuse the law, they end up hurting themselves spiritually
more in the long run just the same as men ...
