थाना चंदपा, हाथरस में हत्या एवं बलात्कार मामले में एक्टिविस्ट डॉ नूतन ठाकुर द्वारा की गयी शिकायत पर ट्विटर तथा शिकायत में अंकित वेब साइटों पर मु०अ०स० 156/2020 धारा 228ए आईपीसी तथा 72 आईटी एक्ट के अंतर्गत मुक़दमा दर्ज किया गया है.
29 सितम्बर 2020 को भेजी अपनी शिकायत में नूतन ने माइक्रो-ब्लॉगिंग साईट ट्विटर पर पीडिता का नाम लिए जाने, उसके नाम से ट्विटर पर विभिन्न हैशटैग चलाये जाने, पीडिता की फोटो तथा विडियो शेयर किये जाने आदि के संबंध में विधिक कार्यवाही की मांग की थी. उन्होंने कहा था कि पीडिता की फोटो के साथ ही उसकी पहचान को उजागर करते कई विडियो भी यूट्यूब पर डाले गए हैं.
उन्होंने कहा था कि धारा 228ए आईपीसी के अनुसार रेप पीडिता की पहचान का प्रकटीकरण दंडनीय अपराध है. सुप्रीम कोर्ट ने भी निपुण सक्सेना केस में स्पष्ट किया है कि किसी भी स्थिति में रेप पीडिता की पहचान नहीं उजागर की जाये.
चंदपा थाना ने आज नूतन को अवगत कराया कि कल 06 अक्टूबर को इस सम्बन्ध में एफआईआर दर्ज कर लिया गया है तथा मृतिका के वास्तविक फोटो, विडियो साइटों से हटवाने को रिपोर्ट प्रेषित की जा रही है.
Hathra Police registers FIR on Twitter, websites for disclosing Identity
FIR No 156/2020 under sections 228A IPC and 72 Information Technology Act has been registered at police station Chandpa, Hathras against Twitter and other named Internet sites on the complaint presented by activist Dr Nutan Thakur in the rape and murder case.
Nutan had presented her complaint on 29 September 2020 seeking legal action as regards disclosure of the name of rape victim and widespread circulation of her photographs on twitter and other social sites. She had said that many You-tube videos are also revealing her identity in various ways.
She had said section 228A IPC clearly makes disclosure of identity of rape victim a punishable offence, which has been reiterated by Supreme Court in Nipun Saxena vs Union of India.
Chandpa Police today informed Nutan that FIR has been registered on 06 October 2020 and report is being sent to get the actual photos, video and identity of the deceased removed from websites.
